Terms of Service

By accessing or using PosterVibe at https://postervibe.app (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization.

If you do not agree to these Terms, you must not use the Service.

You must be at least 13 years old (or 16 in the EU) to use the Service. By creating an account you represent that you meet this age requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@postervibe.app if you suspect unauthorized access to your account.

We reserve the right to terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for more than 24 months.

You agree not to use the Service to:

• Upload, create, or distribute content that infringes on the intellectual property rights of third parties • Create posters that defame, harass, threaten, or abuse any individual or group • Distribute malware, spam, or other harmful code • Attempt to gain unauthorized access to our systems or other users' accounts • Scrape, crawl, or extract data from the Service using automated tools without written permission • Circumvent any usage limits or access controls • Resell or sublicense access to the Service without our written consent

We reserve the right to remove any content and suspend or terminate accounts that violate these rules.

**Your content.** You retain ownership of the poster designs you create. By saving designs to our servers, you grant PosterVibe a limited, non-exclusive license to store and display that content solely to provide the Service to you.

**Our content.** The PosterVibe platform, including all templates designed by us, software, logos, and brand assets, is owned by PosterVibe and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works from our templates for resale or redistribution.

**Third-party content.** Album artwork, artist names, and album metadata displayed in the Service are the property of their respective rights holders. PosterVibe uses this data via licensed APIs for informational purposes only. You are responsible for ensuring your use of album artwork complies with applicable copyright law.

**Free plan.** The free plan provides limited access to the Service at no charge. We reserve the right to modify or discontinue the free plan at any time with 30 days' notice.

**Paid plans.** Paid subscriptions are billed on a monthly or annual basis, as selected at checkout. Payments are processed by Stripe and are non-refundable except as required by law or as described in our 7-day money-back guarantee (see Section 7).

**Auto-renewal.** Subscriptions renew automatically at the end of each billing period. You may cancel at any time; your access continues until the end of the current period.

**Price changes.** We will notify you at least 30 days in advance of any price increases. Continued use after the price change takes effect constitutes acceptance.

If you are not satisfied with a paid plan, you may request a full refund within 7 days of the initial purchase by contacting us at legal@postervibe.app. Refunds are not available for renewals, annual plan mid-term cancellations, or accounts terminated for Terms violations.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected. Album metadata is sourced from third-party APIs and may be inaccurate or incomplete.

To the maximum extent permitted by applicable law, PosterVibe and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or goodwill, arising from your use of or inability to use the Service.

Our total liability to you for any claims arising under these Terms shall not exceed the greater of (a) USD $100 or (b) the amount you paid to us in the 12 months preceding the claim.

You may delete your account at any time via the Dashboard → Account tab. Upon deletion, your data will be permanently removed within 30 days.

We may suspend or terminate your account immediately if you breach these Terms, without obligation to provide a refund for any unused portion of a paid plan.

These Terms are governed by the laws of the jurisdiction in which PosterVibe is registered, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction, and you consent to personal jurisdiction therein.

We may revise these Terms at any time. For material changes, we will notify you by email at least 14 days before the new Terms take effect. Your continued use of the Service after the effective date constitutes your acceptance.
